1. Introduction

NovaSvet (“we,” “us,” or “our”) provides an online platform that allows users to connect, create profiles, share posts, upload photos, videos, stories, and interact with other users’ content through likes, comments, and messages.

“User” or “you” means any individual or legal entity who accesses or uses the Services.

“User Content” means any Content uploaded, posted or otherwise made available by users.
“NovaSvet Content” means content created by NovaSvet (including software, designs, images, logos, text) and materials owned by NovaSvet.
“Social Media Channels” refers to NovaSvet’s pages and accounts on platforms such as Facebook, Instagram, TikTok, X (formerly Twitter), Pinterest, etc.

2. Acceptance of Terms

By registering, accessing, or using NovaSvet, you agree to:

You must be at least 16 years old to use NovaSvet. If you are between 13–16, you may use NovaSvet only with parental or guardian consent.
You must have the legal capacity to form a binding contract under Nigerian law.
You may not use NovaSvet if you are banned, suspended, or otherwise restricted by us.

4. Account Creation & Security

You agree to provide accurate, current, and complete information during registration.
You are responsible for maintaining the confidentiality of your username and password.
You are fully responsible for all activity under your account.
Notify NovaSvet immediately if you suspect unauthorized access.

6. User Content: Ownership & License

You retain ownership of any photos, videos, audio, text, or other materials you post on NovaSvet (“User Content”).

However, by posting or uploading content, you grant NovaSvet a non-exclusive, worldwide, royalty-free, perpetual, transferable, and sublicensable license to:

Use, host, store, display, reproduce, modify, adapt, publish, distribute, and promote your content across our Services.
Use your username, likeness, and public profile in connection with your content.

This license allows NovaSvet to operate, promote, and improve the platform.

You may delete your content at any time, but copies may remain in system backups for a limited time.

7. Content Guidelines and Restrictions

To maintain a safe environment, you must not post content that:

Violates any law, regulation, or court order.
Contains hate speech, harassment, or targeted abuse.
Is pornographic, sexually explicit, or promotes adult services.
Promotes self-harm, violence, terrorism, or illegal activities.

NovaSvet reserves the right to remove or disable access to any content that violates these rules.

8. Community Rules & Prohibited Activities

You agree not to:

Use NovaSvet for spam, phishing, fraud, or pyramid schemes.
Engage in bullying, intimidation, or exploitation.
Use bots, scripts, or automation to manipulate engagement.
Sell or transfer your account without our written permission.

To the fullest extent permitted by law, NovaSvet, its owners, directors, employees, or partners shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to:

Lost profits, revenue, or data;
Service interruptions or system failures;
Unauthorized access to your account or data.

Your sole remedy for dissatisfaction with NovaSvet is to stop using the Services.

19. Indemnification

You agree to defend, indemnify, and hold harmless NovaSvet, its affiliates, officers, agents, and employees from and against all claims, damages, liabilities, and expenses arising out of:

20. Termination & Account Suspension

We may suspend, restrict, or terminate your access to NovaSvet at any time if:

We detect suspicious, fraudulent, or harmful activity.
We decide to discontinue certain Services.

Upon termination, your right to use NovaSvet will cease immediately, but sections relating to intellectual property, limitation of liability, and indemnification will survive.

21. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Nigeria.
You agree that any disputes will be resolved exclusively in the courts of Lagos State, Nigeria, unless otherwise required by law.

22. Dispute Resolution & Arbitration

If any dispute arises, both parties agree to first attempt resolution through good-faith negotiation.
If unresolved, disputes shall be settled by confidential arbitration in Lagos, Nigeria, under the rules of the Arbitration and Conciliation Act.
The arbitrator’s decision shall be final and binding.

23. Changes to Terms

We may update these Terms periodically.
When we make significant changes, we will update the Effective Date and may notify you via email or platform notice.
Your continued use after changes means you accept the revised Terms.

24. Notice & Communication

We may send you notices by email, in-app notifications, or posting them on the site.

These Terms, along with our Privacy Policy and other published guidelines, represent the entire agreement between you and NovaSvet regarding your use of the Services.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full effect.

Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.
